These Host Terms and Conditions form a legally binding contract between you and Nestaura, a property booking platform operating in Kenya. By listing your property on Nestaura, you confirm that you have read, understood, and agreed to comply with the terms outlined below.
1. Eligibility and Registration: To become a Host on Nestaura, you must be at least 18 years old and capable of entering a binding legal agreement. All Hosts are required to register with accurate details including their full name, contact information, property details, and verification documents such as a government certificate.
2. Listing Requirements: Hosts agree to provide accurate and complete information about their property, including availability, pricing, amenities, location, house rules, and photographs. Listings that contain false, misleading, or incomplete information may be removed without notice. Nestaura requests to have knowledge of every room availability to avoid problems of accepting bookings of rooms that are already booked offline. Hosts are required to submit quality photos that will attract customers for listing, you may consider getting a professional photographer to take good pictures.
3. Host Responsibilities: Hosts are responsible for maintaining the quality, cleanliness, safety, and legality of their property. Hosts agree to be available for communication with Nestaura and guests to resolve issues promptly. Hosts must not discriminate against guests or violate any applicable housing laws.
4. Bookings and Cancellations: Nestaura accepts the booking request since we will have full details of the availability of rooms and hosts agree to honor confirmed reservations unless there is a valid reason such as an emergency. Frequent cancellations may result in penalties or removal from the platform. Hosts are encouraged to clearly communicate their cancellation policy.
5. Service Fees and Payments: Nestaura charges a 10% commission on each successful booking. This is automatically deducted from the total amount before payout. To minimize transaction fees, payments are remitted to hosts at the end of each week via the host’s preferred payment method (e.g., bank or mobile money or paypal account). Nestaura offers other services like customer service and marketing for hosts for FREE.
6. Taxes and Compliance: Hosts are solely responsible for complying with all tax regulations applicable to their location, including VAT, income tax, or local levies. Nestaura may provide transaction summaries to assist Hosts in preparing tax reports but does not offer legal or tax advice.
7. Content and Intellectual Property: Hosts retain ownership of the content (e.g., photos, descriptions) they upload but grant Nestaura a non-exclusive, royalty-free license to use, reproduce, display, and promote such content on the platform and in marketing materials. In addition, Nestaura does not allow the display of the host brand name in the listing.
8. Prohibited Conduct: Hosts may not engage in any activity that violates applicable law, infringes on intellectual property rights, promotes discrimination, or endangers guest safety. Fraudulent listings, fake reviews, and misleading information will result in immediate suspension or legal action.
10. Limitation of Liability: Nestaura is a platform provider and does not own or control any of the properties listed. We are not liable for direct or indirect damages arising from stays, property issues, or guest behavior. Hosts are encouraged to obtain appropriate insurance coverage.
11. Indemnification: Hosts agree to indemnify and hold Nestaura harmless against any claims, losses, damages, or legal fees arising from their listings, content, or interactions with guests.
12. Dispute Resolution: In the event of a dispute between the Host and a guest, Nestaura will make reasonable efforts to mediate. However, Nestaura is not responsible for resolving legal disputes. Hosts are encouraged to document all communications and transactions.
13. Modifications: Nestaura may update these Terms and Conditions from time to time. Continued use of the platform after changes are posted constitutes your acceptance of the revised terms.
14. Governing Law: These Terms are governed by the laws of the Republic of Kenya. Any legal proceedings will be handled within Kenyan jurisdiction.
